1. Agreement to Terms

By accessing or using StartClaw ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. StartClaw is operated by StartClaw Inc. ("we", "us", or "our").

2. Description of Service

StartClaw provides a cloud-based platform for deploying and managing OpenClaw agents. Our Service includes hosting infrastructure, platform integrations (WhatsApp, Telegram, Discord, Gmail, Google Calendar, and more), a management dashboard, and related support services.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. User Controls & Responsibility for Automations

You control which integrations you connect and which automations run. You are responsible for reviewing and configuring workflows before enabling them. StartClaw acts on your instructions and settings.

5. Email Behavior (Gmail Integration)

Unless explicitly configured by you, StartClaw does not permanently delete Gmail messages. Inbox automations may include labeling, archiving, and marking messages read/unread based on your settings. You can disconnect Gmail access at any time from your dashboard or from your Google account permissions.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or automated bulk communications
• Conduct phishing or impersonation activities
• Harass, abuse, or harm others
• Distribute malware or engage in malicious activities
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Resell or redistribute the Service without authorization

We may suspend accounts that misuse messaging features, including email, WhatsApp, Telegram, or any other connected platform.

7. Payment & Billing

Paid plans are billed in advance on a monthly basis. By subscribing to a paid plan, you agree that:

• You authorize us to charge your payment method for recurring subscription fees
• Your subscription renews each billing period unless canceled
• You can cancel anytime in your account settings
• Fees are non-refundable except where required by law or explicitly stated
• We may change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account

8. Intellectual Property

The Service and its original content, features, and functionality are owned by StartClaw Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you create using our Service.

9. Third-Party Services

The Service integrates with third-party platforms including Google (Gmail, Calendar, Contacts, Tasks), WhatsApp, Telegram, and Discord. Your use of these integrations is subject to the respective terms of service of those platforms. We are not responsible for the availability or functionality of third-party services.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time through the dashboard settings.

11. Limitation of Liability

To the maximum extent permitted by law, StartClaw Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Disclaimer of Warranties & Support

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

StartClaw may experience interruptions. We do not guarantee uninterrupted operation. We provide support via email and Discord, and will make reasonable efforts to resolve issues in a timely manner.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting an update on our website or sending you an email. Your continued use of the Service after changes become effective constitutes acceptance of the new terms.
